Any client placing orders through our online system at GPUYard must confirm and guarantee that they are at least 18 years old and possess the legal capacity to enter into this agreement.
If the client is below 18 years of age, they are required to promptly inform us and terminate their services. They will be prohibited from using any other services provided by this Company.
Clients under the age of 18 must obtain explicit consent from their parents or legal guardians to access this site and engage in any of our services. We disclaim all liabilities and responsibilities concerning difficulties or legal issues relating to a client's age misrepresentation.
Before gaining access to GPUYard’s control panels, you will be required to provide personal information, which we safeguard in our records. The customer must ensure all information is complete, accurate, and truthful. We reserve the right to refuse access to our services if we find any errors, omissions, or falsifications in the data provided. We also retain the authority to terminate or suspend your access at any time without a refund if fraudulent activity is suspected.
Subject to these Terms and Conditions, we grant you a limited, non-exclusive, non-transferable personal license to access and utilize our services. Our services are exclusively for private and authorized commercial purposes; all unlawful uses are strictly prohibited. You are obligated to prevent any unauthorized intrusion or misuse of our services. We reserve the right to impose bandwidth limits and enforce network security measures. Unauthorized utilization of our services will result in immediate termination of this limited license, and violators may be subject to legal prosecution to the fullest extent permitted by applicable law.
To maintain a secure, compliant, and trustworthy infrastructure, GPUYard enforces a mandatory KYC policy.
Customers must provide accurate and original details, including Full Name, Email Address, Phone Number, Address, Country, and Postal Code.
If fake or inaccurate information is detected, you will be given one opportunity to correct and resubmit your details using a valid government-issued ID and biometric verification. We welcome customers globally; however, orders placed via VPNs, Proxies, or Tor networks will be automatically flagged and rejected.
If you are unable to provide the required valid KYC details, refunds will strictly be issued ONLY for payments made via Visa, Mastercard, and American Express (Amex). Payments made through Cryptocurrency, alternative gateways, or any other non-reversible methods are strictly non-refundable in the event of a KYC failure. If KYC fields are intentionally left empty or fake information is submitted, your account will be permanently banned. Any funds associated with a banned account will be frozen, and no refund will be issued under any circumstances.
Your personal information will never be sold, leaked, or shared with any unauthorized third party. GPUYard is fully committed to keeping your data secure and confidential.
GPUYard will initiate the setup of your chosen services only upon receiving full payment. You will receive an invoice at least 14 days before the due date. It is your responsibility to ensure prompt payment.
Should your account have an outstanding balance for over 24 hours, GPUYard reserves the right to suspend or terminate your services until complete payment is made. We accept Credit Cards, Crypto (Bitcoin/USDT), Wire Transfers, and other verified methods.
GPUYard does NOT issue refunds, except in cases covered by our Service Level Agreement (Section 11) or in the event of a proven billing discrepancy.
When utilizing Credit Card payments, you are responsible for the automated subscription that activates upon purchase. Funds will be automatically deducted on each due date. We do not provide refunds for automated subscription renewals. To cancel, you must manage the cancellation via your client portal or submit a ticket prior to the renewal date.
For dedicated GPU server rentals, standard set-up fees are waived unless necessitated by custom third-party requirements.

All materials accessible through our network constitute our proprietary information. We do not tolerate copyright infringement. You may not copy, distribute, modify, or transmit our website content without prior written consent. You do not acquire any ownership or intellectual property rights through the use of our services.
To ensure the security, stability, and integrity of our global network, we enforce a strict Acceptable Use Policy (AUP). The use of our services to host, store, transmit, or promote any of the following content or activities is strictly prohibited:
If your account is found to contain any illegal activity, such as illegal MP3 files, pirated software, hacker programs, warez programs, or any other illegal files, your account will be immediately terminated without prior notice. Furthermore, GPUYard will report your actions to the appropriate authorities.
Violation Consequence: We maintain a strict, zero-tolerance policy against the aforementioned activities. We reserve the right to actively monitor network traffic for abuse. Should any account be found in violation of this Acceptable Use Policy, we reserve the absolute right to immediately suspend, wipe, or permanently terminate the offending server/account without prior notice.
No Refund Policy: Under no circumstances will a refund be issued for services terminated due to a violation of these terms. Law enforcement will be notified where applicable.
Please be strictly advised that this server must not be used for any illegal, malicious, or unauthorized activities. If you are found using this server for any unlawful purposes, your server will be immediately terminated without prior notice or refund.
We maintain a strict Zero-Tolerance policy regarding Dark Web operations and Ransomware. If this server is found to be hosting, distributing, or facilitating Ransomware, Tor Exit Nodes for malicious use, or any Dark Web marketplaces, the server will be immediately seized. Furthermore, your exact IP logs, connection history, and complete personal KYC verification details will be unconditionally handed over to international cybercrime units and local law enforcement agencies for immediate prosecution.

GPUYard reserves the right to assume ownership of colocated equipment if an account remains more than 30 days overdue.
If you fail to make timely payments or violate any terms of this agreement, we may suspend or terminate services immediately. Upon termination, we reserve the right to securely wipe all data stored on the servers.
Requested upgrades will take effect at the start of your next billing cycle unless an immediate upgrade is fully paid for.
Standard setups are completed within 24 hours. Dedicated GPU server provisioning times may vary based on hardware availability.
Cancellations must be submitted via a verified support ticket at least 24 hours before the upcoming billing due date. By requesting a cancellation, you acknowledge liability for any charges incurred up to the termination date. No pro-rated refunds will be issued for mid-cycle cancellations.
We guarantee a 99.99% network uptime. If we fail to meet this guarantee due to internal network faults, you may be eligible for service credits. Setup fees are strictly non-refundable. For any technical difficulties, clients must contact our support team for immediate resolution.
GPUYard does not automatically back up client data unless a specific managed backup service is purchased. The subscriber is solely responsible for maintaining independent, off-site backups of all data stored on our servers.
Under no circumstances shall GPUYard, its directors, or employees be held liable for any data loss, hardware failure, hardware degradation, security breaches, loss of profits, or indirect business damages resulting from the use or inability to use our services.
GPUYard shall not be held liable for any failure or delay in performing its obligations under this TOS if such failure is caused by circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, wars, acts of terrorism, government restrictions, massive global internet outages, or power grid failures.
GPUYard reserves the right to amend these Terms and Policies at any time. Changes will be implemented by posting the updated TOS on our website. Your continued use of our services following any updates constitutes your explicit acceptance of the revised terms. If you do not agree with the amendments, you must immediately submit a cancellation request and cease using our services.
These Terms of Service shall be governed by and construed in accordance with the laws of the United States. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in the United States.
